Pickyhire Inc. ("Pickyhire", "we", "us", or "our") provides specialized recruitment and consulting services (c for the identification and placement of accounting and financial professionals. These services are offered to businesses, including but not limited to startups and small enterprises, seeking to employ or contract accounting professionals for roles such as, but not limited to, Chief Financial Officer (CFO), Controller, Accounting Manager, and other financial leadership positions. These Terms outline the rules governing your use of and access to the Site and establish a legally binding agreement between you and Pickyhire. They include any additional terms posted by Pickyhire on the Site or provided to you by Pickyhire.
The Privacy Policy explains how Pickyhire may use and disclose information collected about all users and viewers through the Site.
Please carefully review these Terms and Policy. By accessing or using the Site, you agree to be bound by them. If you do not agree, do not use or access the Site or Services.
We may update these Terms and/or Policy by notifying you through the Site or by other reasonable means. Changes will not apply to any disputes between you and us that arose before the effective date of the updated Terms or Policy.
2. Client Services
At Pickyhire, we offer a comprehensive range of specialized recruitment and consulting services designed to meet the unique needs of our Clients.
2.1 Role definition
Pickyhire provides services to assist in defining the role or job description for the position to be filled by the client. This includes consulting with the client to gather necessary details regarding qualifications, responsibilities, and requirements specific to the position. The client acknowledges that the final content of the job description is subject to approval by the client.
2.2 Job posting & sourcing
Pickyhire offers job posting services, including the creation and distribution of job advertisements across selected platforms. Additionally, Pickyhire may engage in candidate sourcing through direct outreach, networks, and other methods. Pickyhire makes no guarantee of candidate availability or quality through the sourcing process.
2.3 Resume screening
Pickyhire offers resume screening services, which may include the filtering of candidates based on qualifications outlined by the client, such as educational background, certifications, and relevant experience. Pickyhire provides these services as part of the recruitment process, but makes no representations or warranties regarding the ultimate suitability of any candidate for employment.
2.4 Skills assessment
Pickyhire offers candidate skills assessment services, which may include testing or practical evaluations to determine the competencies of a candidate in specific areas. The client is responsible for specifying the skills to be assessed. While Pickyhire endeavors to provide accurate evaluations, Pickyhire disclaims any liability for the accuracy or predictive reliability of such assessments.
2.5 Expert interview
At the request of the client, Pickyhire will conduct interviews with candidates as part of the evaluation process. These interviews are performed by professionals with expertise in the relevant field (e.g., accounting, finance). Pickyhire provides feedback based on the interviews but does not guarantee the performance or qualifications of the candidate as presented during the interview process.
2.6 Background check
At the request of the client, Pickyhire will conduct background checks on selected candidates, which may include verification of employment history, educational qualifications, and criminal background (where applicable). The scope of the background check shall be determined in consultation with the client, and Pickyhire shall not be liable for any inaccuracies or omissions in the information obtained.
2.7 Salary benchmarking
Pickyhire provides salary benchmarking services, offering comparative data on industry standards for compensation based on role, experience, and geographical location. Pickyhire compiles data from multiple sources to provide this service but makes no representations regarding the accuracy or completeness of such data. The final salary offer remains at the discretion of the client.
2.8 Onboarding support
Pickyhire may offer onboarding support to assist clients in integrating newly hired candidates into their organization. This may include providing advice on the setup of job functions, reporting structures, and performance expectations. The scope of onboarding support shall be defined by the client. Pickyhire is not responsible for the candidate's performance post-hire.
2.9 Contract-to-hire option
Pickyhire offers a contract-to-hire option, wherein a candidate may be employed on a temporary or contract basis with the option for permanent employment at the client’s discretion. Pickyhire facilitates this arrangement, but any decision regarding the conversion of the candidate to permanent employment rests solely with the client.
3 Termination
These Terms will remain in effect until terminated by either party.
We may terminate these Terms for cause, such as a Client's breach of these Terms, non-payment of fees, or providing false or misleading information.
Clients may terminate these Terms at any time upon written notice. However, Clients will be responsible for payment of all fees earned for services rendered up to the date of termination.
3.1 Disclaimers
We did not independently verify the information provided by job seekers, including their certificates, education, or work background. Clients may request a background check for an additional charge or choose to conduct their own background checks.
4. Limitation of Liability
We shall not be liable for any damages arising out of your use of the Services, including without limitation, direct, indirect, incidental, special, consequential, or punitive damages arising from:
By using our Services, both Clients and job seekers acknowledge and agree to these limitations of liability.
5. Intellectual Property
The content of our website and Services, including text, graphics, logos, and images, is protected by copyright and other intellectual property laws. Unauthorized copying, distribution, modification, transmission, or commercial exploitation is prohibited without prior written consent.
Any intellectual property created by our contractors during their contract period is the exclusive property of Pickyhire. Contractors agree to assign all rights, titles, and interests in such intellectual property to Pickyhire and will cooperate in perfecting and protecting these rights.
6. Confidentiality
We uphold the confidentiality of all Client information, except for information that is publicly known or legally mandated for disclosure. Job seekers must honor the confidentiality of any sensitive information shared by Clients during the interview process. Clients may require job seekers to execute a separate confidentiality agreement.
Similarly, Clients must honor the confidentiality of job seekers' information, including personal information, resumes, assessment results, and any other details provided during the hiring process. This information must be used solely for candidate evaluation and hiring and must not be disclosed to unauthorized third parties.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
8. Entire Agreement
These Terms constitute the entire agreement between you and us regarding the use of the Services.
9. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Services shall be settled by binding arbitration in accordance with the Arbitration Rules of the Canadian Arbitration Association ("CAA"). The arbitration shall be conducted in Toronto, Ontario, Canada. The decision of the arbitrator shall be final and binding on the parties.
10. Indemnification
You agree to indemnify, defend, and hold harmless Pickyhire and its affiliates, including employees, officers, directors, contractors, and agents (collectively, "Pickyhire Parties"), to the fullest extent permitted by law, from all claims, damages, losses, liabilities, fees, and costs (including attorneys' fees) arising from: (a) your use or misuse of the Sites, Content, or Services; (b) any Feedback you provide; (c) your violation of these Terms; (d) your violation of others' rights; (e) third-party use or misuse of the Site or Services provided to you; and (f) any User Content you create or share. You agree to promptly notify Pickyhire of any third-party claims and cooperate in the defense. Pickyhire Parties shall control the defense or settlement of any claims. This indemnity is in addition to any other indemnities in written agreements between you and Pickyhire.
11. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
12. Waiver
No waiver by us of any breach of these Terms shall be deemed a waiver of any subsequent breach.
13. Amendments
We may revise these Terms at any time by updating this posting. You are bound by any revisions and should therefore periodically visit this page to review the current Terms.
